TERMS OF ENGAGEMENT
Terms of Engagement: Strong and Nourished 6-Week Programme
- Introduction
Welcome to the Strong and Nourished 6-Week Programme terms. This programme is delivered by Holly Davison of East Fit PT and Josie Jones of The Mindful Cook. By enrolling, you agree to these terms of engagement, which outline the commitments and responsibilities of both parties.
- Programme Overview
Duration: 6 weeks.
Services Included:
- Meal Plans: Three 2-week personalised meal plans, along with shopping lists.
- Community Support: Membership of an online community for encouragement and peer support.
- Live Coaching: Weekly live coaching sessions with Holy Davison and Josie Jones.
- Training Plans: Eighteen bespoke resistance training plans designed to improve strength and fitness.
- Check-ins: Regular check-ins with both Holly and Josie to track progress and adjust as needed.
- Recipes: Access to approximately 100 nutritious recipes to support your meal plans.
- Client Obligations
- Participation: Workouts are delivered weekly. Workouts are delivered in the first week, and then in week 3. It is up to participants to decide when to complete the workouts each week. Participants are encouraged to follow their targets; training plans and meal plans as closely as possible to achieve optimal results. Targets will be reviewed within each check-in and it is up to the client to share information so that adequate support can be given.
- Health Disclosure: All participants must complete a new starter questionnaire prior to the start of the programme. This includes disclosing any pre-existing health conditions or dietary requirements. If, as a result of completing new starter questionnaire, a participant’s health or dietary needs make them unsuitable for the programme, they will be entitled to a full refund.
- Safety: It is the participant’s responsibility to seek medical advice from a healthcare professional prior to starting the programme, especially if they have any concerns about their ability to participate safely. Any injuries or illnesses should be managed with care, informing us and seeking GP advice where needed. The participant will be voluntarily engaging in an acceptable level of exercise, participation involves a risk of injury. If the participant has answered ‘YES’ to one of the questions in the My PT PARQ, the assumption will be that they have sought medical advice and my GP has agreed that they may exercise.
- Payment and Refunds
- Fee: The total cost for the 6-week Strong and Nourished Programme is £246, payable in full before the start of the programme. If a discounted offer is used, the agreed discounted rate will apply.
- Non-Refundable: Please note that once payment is made and the programme has started, it is non-refundable unless the participant is deemed unsuitable for the programme due to health reasons as stated in Section 3.
- Programme Delivery
- Workouts: Workout plans will be provided, and participants can choose when to complete them during the week. There is no requirement to attend live or scheduled workout sessions although some may be offered.
- Meal Plans and Recipes: Meal plans, shopping lists, and access to around 100 recipes will be provided via email and the programme’s online community portal.
- Coaching: Weekly live coaching sessions with Holly and Josie will be held, with details communicated via the online platform.
- Privacy and Confidentiality
- Data Protection: All personal and health information provided by participants will be treated with confidentiality in accordance with the UK’s General Data Protection Regulation (GDPR). Your data will only be used for the purpose of delivering the programme, unless you have subscribed to other emails, in which case your data will be protected under the Privacy Policy set out by the data controller.
- Content Sharing: Participants agree not to share any proprietary content such as workout plans, meal plans, or coaching materials with anyone outside the programme without express permission from the providers.
- Limitation of Liability
Health and Safety: While every effort is made to ensure that the programme is designed to be safe and appropriate for participants, the providers are not liable for any injuries, health complications, or adverse effects that may arise during or after participation in the programme. Participants understand and accept that they are engaging in the programme at their own risk and are responsible for managing their own health. We strongly recommend that participants seek medical advice before commencing any exercise or nutrition plan, particularly if they have any underlying medical conditions or health concerns.
Assumption of Risk: By participating in the programme, participants acknowledge the inherent risks involved in physical activity and dietary changes, and voluntarily assume those risks.
Medical Disclaimer: This programme is not intended as a substitute for professional medical advice, diagnosis, or treatment. Participants should consult with their healthcare provider before beginning the programme to ensure that it is suitable for their personal health circumstances.
Exclusion of Liability: To the fullest extent permitted by law, we exclude any liability for any injury, health complication, loss, or damage that may result from participants failing to follow the instructions provided, engaging in activities beyond their personal fitness level, or failing to seek medical advice. This does not exclude or limit our liability for death or personal injury caused by our negligence.
- Payment Processing
- Payment for the programme will be processed via Kajabi an online course platform, using Stripe and PayPal. Payment details will be securely handled in accordance with UK financial regulations.
- Amendments
- These terms of engagement may be updated by the providers at their discretion. Participants will be informed of any significant changes in writing.
- Governing Law
- These terms and conditions are governed by the laws of England and Wales. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
